2. NATURE OF THE PLATFORM AND DIRECT SERVICE RELATIONSHIP

2.1The Platform is a direct-to-customer digital PR, visibility, and community platform owned, operated, and managed solely by the Operator, who is also the creator, owner, and/or publisher of the Content and the provider of the Services.

2.2The Platform does not function as a marketplace, aggregator, or intermediary connecting third-party service providers or publishers with Users. The Services and Content are provided by or on behalf of the Operator, under the Operator’s sole responsibility.

2.3The relationship between the Operator and the User is a direct contractual relationship governed by these Terms.

2.4By enrolling in a Programme, ordering a Service, or subscribing to the Platform, the User enters into a direct contract with the Operator for the provision of the Services, Content, and related services.

2.5Third-Party Publications are independent of the Operator. They are not parties to these Terms and do not become agents or partners of the Operator merely because a pitch, mention, placement, or listing is made on or through them. Each Third-Party Publication exercises its own independent editorial and platform discretion.

3. ACCEPTANCE OF TERMS

3.1These Terms and Conditions constitute a legally binding agreement between You (the User) and the Operator. By accessing the Platform, completing the registration process, purchasing a Subscription, ordering a Service, or enrolling in any Programme, You confirm and represent that:

3.2If You are registering on behalf of a corporate entity, institution, or other legal person, You represent that You have the authority to bind that entity to these Terms, and references to “You” shall include such entity.

3.3The Operator reserves the right to amend, revise, or update these Terms at any time by posting the revised version on the Platform along with the revised effective date. Your continued use of the Platform following the posting of revised Terms shall constitute Your unconditional acceptance of such revised Terms. It is Your responsibility to review these Terms periodically.

4. DESCRIPTION OF SERVICES

4.1The Operator, through the Platform, provides the following directly to Users, as applicable to the Service, Programme, or Order chosen:

4.2The Operator reserves the right, at its sole discretion, to add, modify, suspend, or discontinue any Service, Programme, feature, or Content at any time, with reasonable prior notice where practicable. The Operator shall not be liable for any inconvenience, loss, or damage arising from such modification or discontinuation, save as required under Applicable Laws.

4.3The Services, Programmes, and Content are provided for the User’s own personal brand or business use. Reselling, white-labelling, or using them for the benefit of third parties requires the Operator’s prior written consent. Use by multiple individuals within a corporate or institutional User requires a separate written agreement with the Operator.

5. ACCOUNT REGISTRATION, ELIGIBILITY AND USER MATERIALS

5.1To enrol in a Programme, order a Service, or access Content, Users must register an account on the Platform by providing accurate, current, and complete information, including their name, a valid email address, and a secure password.

5.2You are solely responsible for maintaining the confidentiality of Your account login credentials and for all activities conducted under Your account. You agree to notify the Operator immediately at [support@wecrawlweb.com] of any unauthorised access to or use of Your account.

5.3The Operator reserves the right to refuse, suspend, or terminate registration of any person or entity at its sole and absolute discretion, without any obligation to provide reasons.

5.4Each User is permitted to maintain only one active account. The creation of multiple accounts for the purpose of circumventing restrictions, exploiting promotions, or misrepresenting identity shall constitute grounds for immediate Termination for Cause without refund.

5.5The Operator may, in compliance with Applicable Laws including the Prevention of Money Laundering Act, 2002, RBI guidelines and/or any other applicable law, require verification of identity or other Know-Your-Customer (KYC) information from Users prior to or during their use of the Platform.

5.6Where You provide information, claims, credentials, testimonials, images, logos, or other materials for use in the Services, You represent and warrant that they are accurate, lawful, and not misleading, that they do not infringe or violate the rights of any third party, and that You are authorised to provide them. The Operator may decline to use, pitch, or publish any material at its discretion, and You remain responsible for the accuracy of all information You supply.

6. FEES, SUBSCRIPTIONS AND PAYMENT

6.1 Fee Structure

The Operator shall determine and display all applicable fees for Services, Programme enrolments, and Subscription plans on the Platform or in the applicable Order prior to purchase. Fees may vary by Service, scope, Programme, Subscription tier, duration, or promotional offer. The Operator reserves the right to revise fees at any time, provided that a change in fee shall not retroactively affect an already-paid Subscription period or an accepted Order. Where a Service is offered on a custom basis, its scope, Deliverables, timelines, and fees will be set out in an Order, which forms part of these Terms and, in case of conflict, prevails for that Service.

6.2 Payment Processing

All payments are processed through a third-party Payment Gateway integrated into the Platform. By completing a transaction, You agree to the applicable terms and conditions of the Payment Gateway provider. The Operator does not store Your credit or debit card details. The Operator shall not be liable for any errors, delays, or failures on the part of the Payment Gateway.

6.3 Goods and Services Tax (GST)

All fees are exclusive of Goods and Services Tax unless explicitly stated otherwise. GST shall be levied and collected in accordance with the Central Goods and Services Tax Act, 2017, the Integrated Goods and Services Tax Act, 2017, and applicable State GST Acts. The applicable rate shall be displayed at checkout.

6.4 Auto-Renewal of Subscriptions

Subscription plans, unless designated as one-time or non-recurring, may be set to auto-renew at the end of each subscription period. By subscribing, You authorise the Operator to charge the then-applicable renewal fee to Your payment method on file. You may cancel auto-renewal at any time through Your account settings before the next renewal date, subject to the refund policy set out in Clause 7.

6.5 Failed Payments

If a payment fails, the Operator reserves the right to suspend or restrict Your access to the Platform, and to pause work on any Service, until the outstanding amount is successfully paid.

7. REFUND AND CANCELLATION POLICY

7.1 User-Initiated Cancellation

A User may cancel their Subscription at any time. Upon cancellation, access to the Programme and Content shall continue until the expiry of the then-current paid billing period. No refund shall be payable for the unexpired portion of the subscription period, except as provided herein.

7.2 Limited Refund Window for Programmes and Subscriptions

A User may apply for a refund within [7] days of the initial purchase of a Programme or Subscription, subject to the following conditions being cumulatively satisfied:

Refunds that are approved shall be processed within [5–10] business days to the original payment method, subject to the timelines of the Payment Gateway.

7.3 Fees for Services

[Because work on a Service begins promptly after the Order, fees for Services are non-refundable once work on the relevant Order has commenced, unless the Order states otherwise or Applicable Laws require a refund.]

7.4 No Refund on Termination for Cause

If the Operator cancels, suspends, or terminates a User’s access to any Service, Programme, Subscription, or the Platform on account of Termination for Cause, including but not limited to any violation of these Terms, Prohibited Conduct, or breach of Applicable Laws, no refund shall be payable to such User for any fees paid, whether in full or in part, and any remaining subscription or access period shall be immediately and irrevocably forfeited. This applies regardless of the User’s characterisation of or objection to the grounds for termination.

7.5 Operator-Initiated Cancellation Without Cause

If the Operator discontinues the Platform, or a specific Service or Programme, for reasons unrelated to any violation by the User, the Operator shall endeavour to provide a partial refund, at its sole discretion, to affected Users.

8. CONTENT OWNERSHIP, INTELLECTUAL PROPERTY, AND LICENCE

8.1 Ownership of Content

All Content available on the Platform is created, produced, and/or owned by the Operator. The Content, including without limitation all video recordings, scripts, presentations, templates, playbooks, reports, methodologies, illustrations, trademarks, logos (including the WE CRAWL WEB name and logo), and any derivative works, is the exclusive intellectual property of the Operator and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other Applicable Laws. The Operator asserts and reserves all rights in and to the Content to the fullest extent permitted by law.

8.2 Platform Technology

No right, title, or interest in the Platform’s underlying technology, software code, user interface design, architecture or its domain name, brand name, trade marks, and trade names is transferred to any User by virtue of these Terms or any Enrolment.

8.3 Limited Licence to Users

Subject to payment of the applicable fees and compliance with these Terms, the Operator grants each User a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and view the Content strictly for their own personal or business purposes during the active period of their Subscription or Programme enrolment. This licence does not include any right to:

8.4 Consequences of Infringement

Any unauthorised use of the Content shall constitute a serious breach of these Terms and an infringement of the Operator’s intellectual property rights. Such conduct shall entitle the Operator to immediately effect Termination for Cause without refund, in addition to pursuing all available civil and criminal remedies under the Copyright Act, 1957, the Information Technology Act, 2000, and other Applicable Laws.

8.5 User-Generated Contributions

To the extent the Platform allows Users to post comments, questions, or other contributions through interactive features, each User grants the Operator a non-exclusive, royalty-free, perpetual, worldwide licence to use, display, and moderate such contributions for the purposes of operating and improving the Platform. Users warrant that their contributions do not infringe any third-party rights and are not otherwise unlawful.

8.6 Deliverables

[Subject to full payment, and unless an Order states otherwise, the Operator grants the User a non-exclusive, perpetual, worldwide licence to use, publish, and share the Deliverables prepared specifically for the User for the User’s own promotional and business purposes. The Operator retains ownership of its templates, methods, tools, and pre-existing materials, and each Third-Party Publication retains all rights in content published on its own properties.]

9. PRIVACY AND PERSONAL DATA PROTECTION

9.1The Operator shall handle all personal data in compliance with:

9.2By registering on the Platform, Users consent to the collection and processing of their personal data for the purposes of account management, Enrolment, order and payment processing, delivery of Services and Programmes, analytics, legal compliance, and fraud prevention.

9.3The Operator shall not sell or transfer Users’ personal data to third parties for marketing or advertising purposes without explicit and informed consent. Personal data may be shared with Payment Gateway providers, cloud infrastructure providers, and competent government or law enforcement authorities as required by Applicable Laws.

9.4Users have the right to request access to, correction of, or deletion of their personal data, subject to the limitations and conditions prescribed under Applicable Laws, by writing to the Operator at [privacy@wecrawlweb.com].

9.5Information that You ask the Operator to include in Deliverables or pitches (such as Your name, bio, photographs, or business details) may be shared with and published by Third-Party Publications, and is thereafter governed by their own policies.

10. PROHIBITED CONDUCT

10.1Users shall not, under any circumstances, use the Platform, any Content, any Service, or any interactive feature thereof for any purpose that is unlawful, abusive, harmful, disruptive, or otherwise in violation of these Terms or Applicable Laws. The following conduct is expressly prohibited and each shall independently constitute “Prohibited Conduct”:
